Terms of Service

These terms cover your use of this website and anything you buy or book from Esk Beef Pty Ltd (ABN 34 673 427 471), a family beef enterprise in the Brisbane Valley, Queensland.

Agreeing to these terms

By using this site, placing an order, or making a booking, you agree to these terms. If you do not agree, please do not use the site or order from us. We may update these terms from time to time, and the version live at the time of your order or booking is the one that applies.

Nothing here limits your rights under the Australian Consumer Law. Where any part of these terms conflicts with rights that cannot be excluded, those rights prevail.

Orders and pricing

All prices are in Australian dollars and include GST unless stated otherwise. Delivery fees are shown separately at checkout. Beef is portioned by weight, so pack weights are approximate; where a product is priced per pack, you pay the price shown and the contents are made up to the advertised weight as closely as portioning allows.

Placing an order is an offer to buy. A contract is formed when we accept your order. We may decline or cancel an order and refund you in full if a product is unavailable, if there was a pricing or description error, if we cannot deliver to your address, or if we suspect fraud.

Payment

Payment is taken at checkout through our payment provider, using the methods shown there. Your card details are handled by the provider and are not stored by us. Orders are not dispatched or scheduled until payment has cleared in full.

Our beef and food safety

Our beef is naturally raised, hormone free and snap frozen the week it leaves the paddock. Most products are delivered frozen; some lines may be supplied chilled. Beef is perishable, so once it reaches you, safe storage and handling are your responsibility. Storage and use-by guidance is printed on each pack.

Using the site

You agree to use this site lawfully and not to interfere with it, misuse it, or try to access it in any way other than as intended. The Esk Beef name, logo, photography, video, recipes and site content belong to us or our licensors. You may not copy or use them for commercial purposes without our written permission.

Liability

To the extent permitted by law, and other than for consumer guarantees that cannot be excluded under the Australian Consumer Law, we are not liable for indirect or consequential loss, and our total liability for any product or service is limited, at our option, to replacing it, resupplying it, or refunding what you paid. We are not responsible for delays or failures caused by events outside our reasonable control, such as weather, flooding, fire, road closures or third-party service failures.

General and governing law

If any part of these terms is unenforceable, the rest still applies. Failing to enforce a term on one occasion does not waive our right to enforce it later. These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that state.
